1. Scope
These General Terms and Conditions apply to all orders placed by consumers through the NEXMOVA online store.

2. Conclusion of Contract
The presentation of products in our online store does not constitute a legally binding offer, but an invitation to place an order.
By completing the checkout process and submitting the order using the designated order button, the customer submits a binding offer to purchase the selected products.
After the order has been placed, the customer receives an electronic order confirmation. The contract is concluded in accordance with the information provided during the ordering process and the applicable checkout procedure.
3. Prices and Payment
All prices displayed in the online store are shown in the applicable currency.
Any applicable shipping costs or other additional charges will be displayed to the customer before the order is submitted.
The available payment methods are displayed during checkout.
Payment processing may be carried out by third-party payment service providers.
4. Delivery and Shipping
Delivery is made to the delivery address provided by the customer during checkout.
Products may be shipped directly by third-party suppliers, warehouses or fulfillment partners. As a result, products from the same order may be shipped separately and may arrive in separate packages.
The applicable estimated delivery times are provided on the relevant product page, during checkout, or in the order information where available.
Delivery times may vary depending on the product, destination, carrier and fulfillment location.
Any mandatory rights of the customer in the event of delayed or failed delivery remain unaffected.
5. Product Information and Availability
We make reasonable efforts to ensure that product descriptions, images, variants and other product information are accurate and up to date.
Minor differences in appearance, including colour differences caused by screen settings or photography, may occur.
If an ordered product becomes unavailable after an order has been placed, we will inform the customer as soon as reasonably possible. Any payments already made for products that cannot be supplied will be refunded.
6. Right of Withdrawal
Consumers have the statutory right of withdrawal in accordance with applicable law.

The statutory right of withdrawal is not restricted by these General Terms and Conditions.

We will provide the applicable return instructions and, where necessary, the appropriate return destination for the specific order.
Customers should not send products to an address without first contacting us, as the appropriate return destination may vary depending on the product and order.
The allocation of return shipping costs and any statutory exceptions to the right of withdrawal are governed by our Right of Withdrawal & Returns policy and applicable law.
8. Damaged, Defective or Incorrect Products
Customers should contact us as soon as possible if a product arrives damaged, defective or incorrect.

The customer's statutory rights in relation to defective goods remain unaffected.

10. Liability
We are liable without limitation where liability is mandatory under applicable law, including in cases of intent or gross negligence and for injury to life, body or health.
For other claims, liability is governed by the applicable statutory provisions.
Nothing in these General Terms and Conditions excludes or restricts liability where such exclusion or restriction is prohibited by law.
11. Third-Party Fulfillment
For logistical purposes, we may use third-party suppliers, warehouses, shipping providers or fulfillment partners to process and deliver orders.
The use of such third parties does not affect the customer's statutory rights against NEXMOVA as the seller.
12. Governing Law
German law applies, subject to mandatory consumer protection provisions.
If the customer is a consumer and has their habitual residence in another country, the protection granted by mandatory provisions of the law of that country remains unaffected where applicable.
